Section 1: Introduction and Acceptance Of Terms
Welcome to Leg Day. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Leg Day Inc. (“we,” “us,” or “our”) governing your access to and use of the Leg Day mobile application and any related services (collectively, the “App”).
By downloading, installing, or otherwise accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you are not authorized to use the App and must discontinue use immediately.
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this document. Your continued use of the App following any such update constitutes your acceptance of the revised Terms.
Section 2: Eligibility
Leg Day is intended for a mature audience interested in fitness and social connection. To create an account and use the App, you must meet the following requirements:
Age: You must be at least 18 years old. By using the App, you represent and warrant that you are 18 or older.
Account History: You must not have been previously removed, suspended, or banned from the App for violating these Terms or our safety policies.
Legal Standing: You represent that you are not prohibited from using the App under the laws of the United States or any other applicable jurisdiction, including under applicable sanctions or restricted party lists.
Section 3: User Generated Content & Conduct
Leg Day provides a platform for individuals to connect in a fitness-related environment. By using the App, you agree to the following standards of conduct:
Prohibited Content: You may not post, upload, or share any content that is:
Objectionable: Including nudity, sexually explicit material, or violence.
Harassing: Including hate speech, bullying, or defamatory statements.
Infringing: Violating the intellectual property rights of any third party (including gym trademarks).
Ownership & License: You retain ownership of the photos and profile data you upload. By posting content, you grant Leg Day a worldwide, non-exclusive, royalty-free license to host, store, and display that content for the purpose of operating, improving, and providing the App.
Enforcement: Leg Day maintains a strict policy against objectionable content. Content reported by users may be reviewed and, if found to violate these Terms, may be removed. We reserve the right, in our sole discretion, to suspend or permanently ban any user found to be in violation of these standards. All decisions regarding enforcement actions are final.
Section 4: Safety & Reporting Mechanisms
Leg Day provides tools designed to support a safe and controlled user experience. By using the App, you acknowledge the following general mechanisms for managing your interactions:
1. Discovery Phase Reporting & Hiding
During the discovery process, you have the ability to manage your experience:
Hide: You may choose to hide other users. When you do so, you and that user will no longer be visible to one another.
Report: You may report a user at any time. Reporting a user may also limit or remove their visibility to you.
2. Post-Connection Reporting
If you have previously connected with another user, you may continue to manage that interaction:
Reporting & Disconnection: You may report or disconnect from another user at any time. Reporting a user may also terminate any existing connection between you.
Administrative Review: Reports may be reviewed by our moderation team and may result in action, including content removal, suspension, or account termination.
3. Safety Controls and Moderation
Leg Day maintains moderation systems designed to review and address user reports:
Moderation: Reports may be reviewed by administrative personnel or automated systems.
Enforcement: If a violation of these Terms is identified, we may take action, including removing content, limiting account functionality, suspending access, or permanently banning a user.
Blocking Functionality: Certain user actions, such as hiding or reporting another user, may limit or terminate interaction or visibility between users.
4. Session Management and Location-Based Features
Leg Day includes features designed to enable real-time, location-based interactions:
Location-Based Visibility: Certain features of the App rely on your presence within supported locations. Your visibility to other users may be limited to periods when you are within, or recently present at, such locations.
Session Behavior: Your activity and visibility within the App may be time-limited and may automatically end based on factors such as location, inactivity, or system design.
Ephemeral Interactions: Certain interactions, profiles, or activity history within the App may not be permanently available and may reset or expire over time.
Section 5: Mutual Connections and External Communication
Leg Day is designed to facilitate introductions between users and may enable the sharing of contact information between mutually interested individuals. We may offer or modify communication features over time.
Consent to Share: By selecting certain contact preferences or otherwise choosing to share information, you authorize Leg Day to share the information you provide with a mutual connection.
Third-Party Communication: In some cases, the App may facilitate connections to third-party platforms or services. Your interactions on those platforms are governed by their respective terms and policies.
Discretion: We are not responsible for the content, frequency, or nature of communications that occur outside of the App. You acknowledge that you engage in such communications at your own risk.
Section 6: Non Affiliation Disclosure
Leg Day is an independent platform developed by Leg Day Inc. We are not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with any gyms, fitness facilities, or related entities, including but not limited to Equinox and Life Time, or any of their respective subsidiaries or affiliates.
All third-party names, trademarks, service marks, logos, and brand elements referenced within the App are the property of their respective owners. Any use of such names or marks is for identification and descriptive purposes only and does not imply any affiliation with or endorsement by the respective trademark holders.
The App may reference or utilize location-based features or proximity-based functionality in connection with certain venues. Such references are provided for user convenience and identification only and do not imply any partnership, sponsorship, or endorsement by the owners or operators of those locations.
Section 7: Third-Party Venues and Conduct
Leg Day is a platform for introductions. We do not own, operate, or maintain any gym, fitness facility, or other third-party venue. You agree to abide by all applicable rules, codes of conduct, and membership agreements of any physical location where you may interact with other users.
Leg Day is not responsible for any disputes, injuries, damages, or membership terminations that may occur at any third-party location in connection with your use of the App.
Section 8: Limitation of Liability and Governing Law
Limitation of Liability: To the maximum extent permitted by law, Leg Day and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or personal injury, arising out of or in connection with your use of the App or your interactions with other users.
Indemnification: You agree to indemnify, defend, and hold harmless Leg Day and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your conduct at any third-party venue.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction and venue of such courts.
